Tel Aviv District Appeals Committee decides to oblige apartment sellers in Improvements Levy

The meaning of the decision is obliging apartment sellers in the 3rd district (most of the old north of Tel Aviv - from Bograshov st in the south to Yarkon River in the north) with the improvement levy, when selling their apartments even without actual exercise of rights.


In a decision in a series of appeals filed by property owners on the Tel Aviv municipality's improvement levy assessments, the committee determined that, in contrast to the TMA 38 plan that exempts the improvement levy (and on the basis of which the District 3 plan was issued), the District 3 plan ) establishes concrete rights thus led to an increase in the value of the assets - therefore requiring an improvement levy.


Despite the principled determination, the committee recommended that in each deal, the municipality appraiser should examine each case individually and take into account an expected delay in the implementation of the plan, the characteristics of the property and the feasibility of implementing the plan in relation to the property in question.


We recommend to anyone who is expected to sell an apartment in the District 3 area of ​​Tel Aviv, to take into account the issue of the improvement levy and, if necessary, to hire the services of a real estate appraiser who is knowledgeable in the field and in the District 3 area.
